Section 01

Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the Kepher Fashion website, products, and services (collectively, the "Services"). They should be read in conjunction with our Privacy Policy, which is incorporated into these Terms by reference.

We reserve the right to update these Terms at any time. Continued use of the Site following any changes constitutes acceptance of the revised Terms. The most current version will always be posted at kepher.co/pages/terms-of-service.html with the "Last Updated" date noted above.

Section 02

Eligibility

To use our Services, you must:

• Be at least 18 years of age, or at least 13 years of age with verifiable parental or guardian consent
• Have the legal capacity to enter into a binding contract in your jurisdiction
• Not be prohibited from receiving our Services under applicable law
• Provide accurate and complete information when creating an account or placing an order

By using the Site, you represent and warrant that you meet all of these eligibility requirements. If you are using the Site on behalf of a business entity, you represent that you have authority to bind that entity to these Terms.

Section 03

Your Account

You may browse our Site without creating an account. However, certain features — including order history, saved addresses, and wishlist functionality — require account registration.

Account Registration

• You must provide accurate, current, and complete information during registration
• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activity that occurs under your account
• You must notify us immediately of any unauthorized use of your account at hello@kepher.co
• You may not create more than one account per person or transfer your account to another party
• We reserve the right to refuse registration, terminate accounts, or remove content at our sole discretion

Account Termination

You may close your account at any time by contacting us at hello@kepher.co. We may suspend or terminate your account if we reasonably believe you have violated these Terms, engaged in fraudulent activity, or posed a security risk to our platform or other users. Upon termination, your right to use the Site ceases immediately. Order history and data retention following termination is governed by our Privacy Policy.

Products & Pricing

Product Descriptions

We strive to display our products as accurately as possible, including colors, materials, and dimensions. However, we cannot guarantee that your device's display will accurately reflect the actual appearance of our products. Slight variations in color, texture, and pattern placement may occur due to the custom, print-on-demand nature of our production process. These variations are inherent to handmade and digitally printed goods and do not constitute defects.

Pricing

• All prices are listed in U.S. Dollars (USD) unless otherwise stated
• Prices are subject to change without notice
• We reserve the right to correct pricing errors at any time. If a pricing error is discovered after your order is placed, we will notify you and offer the option to proceed at the correct price or cancel for a full refund
• Promotional pricing and discount codes are subject to their own terms and expiration dates
• Prices do not include applicable taxes or shipping fees, which are calculated at checkout

Taxes

Sales tax is calculated and collected in accordance with applicable state and local laws. Kepher Fashion collects sales tax in states where we have a tax nexus as required by law. Customers outside the U.S. are responsible for any applicable import duties, customs fees, or local taxes imposed by their country or jurisdiction.

Product Availability

Because Kepher Fashion operates on a print-on-demand model through third-party production partners, most items are available to order without stock limitations. However, certain limited-edition drops and special releases may have quantity restrictions. We reserve the right to limit quantities, discontinue products, or cancel orders if production capacity or materials are unavailable.

Orders & Payment

Placing an Order

When you place an order through our Site, you are making an offer to purchase the selected products at the stated price and under these Terms. Receipt of an order confirmation email does not constitute acceptance of your order — acceptance occurs when we confirm production has begun or your payment has been successfully processed without issue.

We reserve the right to refuse, cancel, or limit any order for any reason, including but not limited to: suspected fraud, pricing errors, product unavailability, or violations of these Terms.

Payment Processing

All payments are processed securely through Stripe, Inc., a PCI-DSS Level 1 compliant payment processor. We accept major credit and debit cards and any additional payment methods offered at checkout. By providing your payment information, you authorize us to charge the full order amount including applicable taxes and shipping fees.

Order Cancellations

Because our products are custom-made to order through print-on-demand production, we have a limited cancellation window of 24 hours from the time of purchase. After 24 hours, production may have already begun and cancellations cannot be guaranteed. To request a cancellation, contact us immediately at hello@kepher.co with your order number.

Fraud Prevention

We employ fraud detection measures to protect our customers and our business. Orders flagged for potential fraud may be delayed, cancelled, or subject to additional verification. We reserve the right to cancel orders and refund payments at our sole discretion if fraudulent activity is suspected.

Section 06

Production & Fulfillment

Kepher Fashion operates on a print-on-demand production model. This means that most items are produced specifically for you after your order is placed, in partnership with our production partners (including Contrado, Printful, ShineOn, JetPrint, and others). This model allows us to offer custom designs with no excess inventory, but it also means:

• Production time is typically 2–7 business days before your order ships, depending on the product category and production partner
• Items in the same order may be fulfilled by different production partners and may arrive in separate shipments
• Limited edition and pre-order items may have extended production timelines, which will be disclosed on the product page
• Slight variations in print placement, color saturation, and fabric texture are inherent to the print-on-demand process and are not considered defects

Production Partner Disclosure

Your shipping name and delivery address are shared with our production partners solely for the purpose of fulfilling and shipping your order. Production partners are contractually prohibited from using your information for any other purpose. Your payment information is never shared with production partners.

Order Tracking

You will receive a shipping confirmation email with a tracking number once your order has been dispatched. Tracking information may take up to 24 hours to update after the tracking number is issued.

Section 07

Shipping & Delivery

Shipping Timeframes

Shipping times are estimates and are not guaranteed. Estimated delivery windows begin after the production period has completed. Standard domestic (U.S.) shipping typically takes 3–8 business days after dispatch. International shipping typically takes 7–21 business days after dispatch, depending on the destination country.

Shipping Carriers

We ship via major carriers including USPS, UPS, FedEx, DHL, and TNT, depending on your location and the production partner fulfilling your order. Carrier selection is at our discretion and that of our production partners.

International Orders

• Kepher Fashion ships to most countries worldwide
• International customers are responsible for all import duties, customs fees, tariffs, and taxes imposed by their country or jurisdiction upon delivery
• We are not responsible for delays caused by customs clearance processes
• We comply with applicable export control laws and may be unable to ship to certain countries or regions

Undeliverable Packages

If a package is returned to us or our production partner due to an incorrect address, failed delivery attempts, or refusal of delivery, we will contact you to arrange reshipment at your expense or issue a refund minus original shipping costs. We are not responsible for packages lost or delayed due to customer-provided incorrect address information.

Lost or Stolen Packages

Once a package has been marked as delivered by the carrier, Kepher Fashion is not responsible for packages that are lost, stolen, or missing from the delivery location. We recommend filing a claim with the shipping carrier and contacting your local post office. We will assist in providing documentation for carrier claims but cannot guarantee reimbursement for delivered packages reported as missing.

Returns & Refunds

Eligible Returns & Replacements

We will provide a replacement or full refund in the following circumstances:

• The item arrived damaged or defective due to manufacturing or shipping fault
• The item received was materially different from what was described or shown on the product page
• The item was lost in transit and the carrier confirms the package was not delivered
• The wrong item was sent due to a fulfillment error on our part

How to Request a Return or Replacement

1. Contact us at hello@kepher.co within 14 days of the delivery date
2. Include your order number and a clear description of the issue
3. Attach photographs showing the defect, damage, or incorrect item
4. We will respond within 2 business days with resolution options

Refund Processing

Approved refunds are processed to your original payment method within 5–10 business days of approval. Processing time may vary depending on your financial institution. You will receive a confirmation email when your refund is initiated.

Non-Returnable Items

• Items returned without prior authorization
• Items showing signs of wear, washing, alteration, or misuse
• Final sale and clearance items (clearly marked at time of purchase)
• Swimwear and intimate apparel (for hygiene reasons)
• Digital products or gift cards

State-Specific Return Rights

California Under California law (California Civil Code §1723), if we do not post a return policy, customers are entitled to a full refund within 30 days of purchase. Our return policy is clearly stated above and supersedes this default.

New York New York consumers are entitled to a written return policy. This section constitutes our written return policy in compliance with New York General Business Law §218-a.

Regardless of your state, if you receive a defective or incorrect item, you are always entitled to a remedy as described in "Eligible Returns" above.

Section 09

Intellectual Property

Our Intellectual Property

All content on the Site — including but not limited to the KEPHER name and wordmark, logo, brand motifs (the winged triangle, sacred geometry patterns, rose gold design language), product designs, surface patterns, photography, text, graphics, and the overall Site design — is the exclusive property of Kepher Fashion and is protected by U.S. and international copyright, trademark, and trade dress laws.

KEPHER® is a trademark of Kepher Fashion Brand. Unauthorized use of our trademarks, trade dress, or brand elements is strictly prohibited and may result in legal action.

Limited License to Use the Site

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for personal, non-commercial purposes. This license does not include:

• Reproducing, distributing, or creating derivative works from any Site content
• Using our brand elements, patterns, or designs on any product, service, or platform
• Scraping, data mining, or automated collection of Site content
• Framing or mirroring any portion of the Site without written permission
• Reverse engineering, decompiling, or disassembling any Site software

User-Submitted Content

If you submit reviews, photos, or other content to our Site or tag us on social media, you grant Kepher Fashion a non-exclusive, royalty-free, worldwide, perpetual license to use, display, reproduce, and distribute that content for marketing and promotional purposes, with appropriate credit where feasible. You represent that you own or have rights to any content you submit.

Copyright Infringement (DMCA)

If you believe your copyrighted work has been used on our Site in a manner that constitutes infringement, please send a DMCA notice to legal@kepher.co including: identification of the copyrighted work, identification of the infringing material and its location on the Site, your contact information, a statement of good faith belief, and your electronic or physical signature.

Section 10

Prohibited Uses

You agree not to use the Site or Services for any unlawful purpose or in any way that could harm Kepher Fashion, our users, or third parties. Prohibited uses include:

• Violating any applicable federal, state, local, or international law or regulation
• Submitting false, misleading, or fraudulent information in orders or account registration
• Using another person's identity, payment information, or account credentials
• Attempting to gain unauthorized access to any portion of the Site, server, or database
• Introducing viruses, malware, or any other malicious code to the Site
• Engaging in any form of automated data collection, scraping, or harvesting without express written permission
• Posting or transmitting harassing, defamatory, obscene, or offensive content
• Interfering with or disrupting the integrity or performance of the Site
• Reselling or commercially exploiting any portion of the Site or its content without authorization
• Placing orders with intent to commit chargeback fraud
• Using our brand name, logo, or trademarks in any way that implies a false association

Violation of these prohibited uses may result in immediate account termination, order cancellation, and may be reported to appropriate law enforcement authorities.

Section 11

Disclaimers

Kepher Fashion does not warrant that:

• The Site will be uninterrupted, error-free, or secure at all times
• Defects will be corrected, or that the Site or its servers are free of viruses or other harmful components
• Product colors, textures, or appearances will match exactly what is displayed on your device
• Any specific results will be obtained from use of the Site or Services

We are not responsible for the content, privacy practices, or actions of any third-party websites linked to or from our Site. Links to third-party sites are provided for convenience only and do not constitute endorsement.

Third-Party Production Partners

While we carefully select our print-on-demand production partners and hold them to quality standards, we cannot guarantee the performance of third-party fulfillment partners. In the event of a production or fulfillment failure by a third-party partner, our liability is limited to a replacement order or refund as described in Section 8.

Section 12

Limitation of Liability

In no event shall Kepher Fashion's total liability to you for all claims arising from or related to the use of the Site or Services exceed the greater of: (a) the total amount paid by you to Kepher Fashion in the twelve (12) months preceding the claim, or (b) one hundred dollars ($100.00).

This limitation applies to all claims, whether based on warranty, contract, tort (including negligence), statute, or any other legal theory, and whether or not Kepher Fashion has been advised of the possibility of such damage.

State-Specific Limitations

New Jersey New Jersey law does not permit the exclusion of implied warranties or the limitation of incidental or consequential damages in certain consumer transactions. If you are a New Jersey consumer, some of the above limitations may not apply to you.

Massachusetts Missouri Some states do not allow limitations on implied warranties or exclusions of certain damages. The limitations above apply to the fullest extent permitted by the law of your state.

Section 13

Indemnification

You agree to defend, indemnify, and hold harmless Kepher Fashion and its officers, directors, employees, agents, and successors from and against any claims, liabilities, damages, judgments, awards, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

• Your violation of these Terms
• Your use of the Site in a manner not authorized by these Terms
• Your violation of any applicable law or regulation
• Your infringement of any third-party intellectual property or privacy rights
• Any content you submit to the Site, including reviews or user-generated content
• Any fraudulent activity committed through your account

Section 14

Dispute Resolution

Informal Resolution First

Before initiating any formal legal proceedings, you agree to contact us at hello@kepher.co and attempt to resolve the dispute informally. We will make a good faith effort to resolve your concern within 30 days. Many disputes can be resolved quickly and without formal proceedings.

Binding Arbitration

If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Site shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall be conducted in the English language. The arbitrator's decision shall be final and binding.

Class Action Waiver Exceptions to Arbitration

The following claims are excluded from the arbitration requirement and may be brought in a court of competent jurisdiction:

• Claims for injunctive or equitable relief to protect intellectual property rights
• Small claims court actions within applicable jurisdictional limits
• Claims that applicable law expressly requires to be brought in court

California Residents — Special Notice

California Under California Civil Code §1750 et seq. (Consumers Legal Remedies Act) and California Business and Professions Code §17200, California consumers may have additional rights that cannot be waived by arbitration agreement. Nothing in these Terms is intended to limit your rights under California consumer protection law.

Section 15

State-Specific Consumer Rights

The following is a summary of additional consumer rights that may apply based on your state of residence. These rights exist independently of these Terms and cannot be waived.

California Consumer Protections

• CLRA (Civil Code §1750) — Prohibits unfair or deceptive acts in consumer transactions. You have the right to seek actual damages, punitive damages, injunctive relief, and attorney's fees for violations
• UCL (B&P Code §17200) — Prohibits unlawful, unfair, or fraudulent business practices
• False Advertising Law (B&P Code §17500) — We warrant that our product descriptions are truthful and not misleading
• Song-Beverly Consumer Warranty Act — Provides implied warranty of merchantability for consumer goods sold in California
• California CCPA/CPRA — See our Privacy Policy, Section 10

Texas Consumer Protections

Texas consumers are protected by the Texas Deceptive Trade Practices-Consumer Protection Act (DTPA), which provides remedies for false, misleading, or deceptive trade practices. Texas consumers may contact the Texas Attorney General's Office for consumer assistance.

Florida Consumer Protections

Florida consumers are protected by the Florida Deceptive and Unfair Trade Practices Act (FDUTPA). Florida residents have additional rights regarding automatic renewal subscriptions, and we will provide clear notice before any free trial converts to a paid subscription.

New York Consumer Protections

New York consumers are protected by General Business Law Article 22-A (§349), which prohibits deceptive acts or practices in the conduct of any business. New York residents have the right to bring a private cause of action for violations.

All States

Nothing in these Terms of Service is intended to limit any consumer rights that cannot be waived or modified by contract under the laws of your state. If any provision of these Terms conflicts with mandatory consumer protection law in your state, such provision shall be modified to the minimum extent necessary to comply with applicable law.

Section 16

Governing Law & Jurisdiction

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Alabama, without regard to its conflict of law provisions. To the extent that any dispute is not subject to arbitration under Section 14, you consent to the exclusive jurisdiction of the state and federal courts located in Montgomery County, Alabama for the resolution of such disputes.

If you are accessing the Site from outside the United States, you do so on your own initiative and are responsible for compliance with local laws. These Terms do not waive any mandatory consumer protections applicable in your country of residence.

Section 17

Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will:

• Update the "Last Updated" date at the top of this page
• Post a prominent notice on our homepage for significant changes
• Where required by applicable law, provide advance notice before changes take effect
• For material changes affecting existing orders, we will honor the Terms in effect at the time of purchase

Your continued use of the Site after the effective date of any revised Terms constitutes your acceptance of those changes. We encourage you to review these Terms periodically. If you do not accept revised Terms, please discontinue use of the Site and contact us to close your account.
